1. Scope & Provider

These Terms & Conditions govern all services, bookings, and flight training inquiries provided by Andrea Cappello ("Fly with Andi"), dual-certified FAA/EASA commercial helicopter pilot and flight instructor, operating in Northern Italy (Valtellina, Milano, Alps, Switzerland) and surrounding regions.

2. Bookings & Contract Conclusion

  • Any inquiry made through the contact form or WhatsApp on flywithandi.com is non-binding.
  • A binding contract is concluded only when you receive written confirmation (via email or WhatsApp) of your booking and agree on the date, price, and flight itinerary.
  • Commercial flight tours may be operated in cooperation with licensed European Air Operator Certificate (AOC) holders (such as Eurotech Helicopter Services, Caiolo - P.IVA 00669210148) to ensure full compliance with European civil aviation laws.

3. Safety & Weather Dependency

  • Helicopter flights are highly weather-dependent. Safety is our absolute priority.
  • The pilot in command has the sole, final, and absolute authority to cancel, postpone, or alter any flight itinerary due to unfavorable weather conditions, airspace restrictions, or safety concerns.
  • In the event of a cancellation by the pilot due to weather, we will offer alternative dates. If rescheduling is not possible, a full refund of any deposit paid will be issued. No compensation is provided for associated travel, lodging, or logistical expenses.

4. Passenger Requirements & Weight Limits

  • For safety and performance reasons, passengers must strictly adhere to aircraft limitations. For flights in the Robinson R44 helicopter, the maximum weight per passenger is 110 kg (242 lbs), and the combined weight of all passengers (maximum 3) must fit within the aircraft's weight and balance envelope.
  • Passengers must disclose their weight accurately during booking. Incorrect weight disclosures may lead to flight cancellation at the passenger's expense.
  • Passengers must follow all pre-flight safety briefings and instructions from the pilot.
  • Flight training candidates must hold and maintain appropriate medical certificates and student pilot licenses where legally required.

5. Cancellations & Rescheduling by the Passenger

  • Cancellations made more than 7 days prior to the scheduled flight: Free rescheduling or full refund of any deposit.
  • Cancellations made between 48 hours and 7 days prior: A 50% fee of the flight price applies, unless rescheduled to a mutually agreeable date.
  • Cancellations made less than 48 hours prior or no-shows: 100% of the flight price is due.

6. Liability & Insurance

  • Flights are covered by the mandatory third-party liability aviation insurance of the operating aircraft.
  • Liability for passenger injuries, baggage loss, or delays is governed by Italian law and applicable international treaties (such as the Montreal Convention).
  • "Fly with Andi" (Andrea Cappello) is not liable for any indirect or consequential damages, or any delays caused by air traffic control, weather, or force majeure.

7. Applicable Law & Jurisdiction

These terms are governed by Italian law. Any disputes arising from these terms or flights shall be subject to the exclusive jurisdiction of the Court of Sondrio (Foro di Sondrio), Italy.
